Our client was charged with the Aggravated Robbery of a man on Bondi Beach.
Our client had distinctive tattoos that should have made it easy for the prosecution to establish a firm identification.
However, some of the prosecution witnesses thought they had seen our client before so they made their own inquiries on Facebook and other social media to try to “put a name to the face”.
By the time any legally admissible identification evidence could be obtained by the police, the identification evidence was so contaminated that we successfully had all of it excluded at court. We were also awarded costs.
